More than a month has passed since the Yongsan tragedy occurred. It took the lives of five civilians and one police officer, but the black smoke, the deadly fire and the desperate screams for help are still vivid in our collective memory. The dead surely do not rest in peace and their families can still be found shedding tears out on the cold streets of Yongsan.

  During a press conference held two days ago, the families of the civilians who died claimed that the horrendous incident occurred during the process of forced evictions and a cruel police crackdown on people protesting an urban redevelopment project in their midst. Since then, more than a month has gone by, but nothing has been resolved. The prosecution’s investigation has tarnished the dignity of the dead and left their families deeply bereaved. This is just one of the reasons why the families have not been able to hold funerals for their loved ones; instead they burn incense at altars constructed in front of Suncheonhang Hostpital in Yongsan.

  The prosecution’s investigation concluded with the police cleared of any criminal charges and the victims of the deadly crackdown indicted. Few would disagree that police’s excessive use of force during the crackdown on the protesters was the main reason for the tragedy and that the incident could have been avoided had the police taken the necessary precautions. In spite of that, the prosecution did not hold a single police officer accountable for the incident and instead arrested six protesters, including a son who lost his father, prompting public anger and arousing allegations of a biased investigation.

    The prosecution ignored testimony by protesters who say they had no choice but to defend their rights by barricading themselves in the rooftop tower on that fateful day. Prosecutors concluded that the fire started in the tower, but failed to clarify whether the Molotov cocktails started the fire and, if so, who threw them. As a response to the cruelty demonstrated by the police, who justify their excessive use of force as an “inevitable” decision to protect law and order, the prosecution’s investigation amounts to nothing less than a deception.

  Aside from the results of the investigation, there seems to be no end to the cruelty being doled out to the deceased and their bereaved families. The government and the ruling party seem bent on covering up the truth. When the police blocked a memorial service a few days ago, a scuffle broke out and a portrait of one of the deceased was destroyed. Such things cannot be permitted under any government that promises to serve the people. The Yongsan tragedy is one of the most shameful stains on the record of this administration and there is nothing that can cover it up.

  As we pay our respects to the late Cardinal Stephen Kim Sou-hwan, a true friend to the poor and underprivileged, it is untenable for us to turn our backs on those he would have regarded as truly bereaved. It goes against his will. We all have a responsibility to clear up any remaining doubts about the Yongsan tragedy. President Lee Myung-bak should apologize to the victims and their families and order a reinvestigation of the incident.

참사 한 달, 잠 못 드는 원혼

  시민 5명과 경찰 1명의 목숨을 앗아간 용산 참사가 한 달을 훌쩍 넘겼다. ‘저 안에 사람이 있다’는 외침, 검은 연기와 뜨거운 불길, 옥상에서 부르짖던 이웃들의 눈물이 아직도 생생하다. 그러나 원혼은 잠들지 못하고 유가족들은 찬거리에서 눈물을 흘리고 있다.

  엊그제 유족들이 기자회견에서 밝힌 대로 강제철거와 살인진압으로 엄청난 참사가 발생했고 그로부터 한 달이 지났으나 지금 해결된 것은 아무것도 없다. 오히려 검찰의 편파·왜곡 수사로 고인의 명예가 심각히 훼손됐고, 유가족의 가슴은 하루하루 새카맣게 타들어가고 있다. 그런 까닭에 유족들은 장례조차 치르지 못하고 추운 날씨에도 천막 분향소를 떠나지 못하고 있다.

  검찰은 ‘살인진압 책임자 무죄, 살인진압 희생자 유죄’라는 짜맞추기 수사결과를 내놓았다. 용산 참사는 안전대책 없이 밀어붙이고 대테러 요원인 특공대원을 투입한 경찰의 과잉진압이 직접적인 원인이다. 경찰이 규정에 맞게 인명 보호를 위한 주의를 다했다면 참사는 막을 수 있었을 것이다. 그런데도 경찰 책임은 묻지 않고 참사로 아버지를 잃은 아들을 포함해 여섯 명의 철거민과 전국철거민연합 관계자들만 구속했으니 공분을 살 수밖에 없다.

  검찰은 철거민들이 망루에 올라갈 수밖에 없었던 절박한 생존권 문제에 대해선 아예 귀를 닫았다. 망루의 화재를 참사의 원인으로 결론내렸지만 정작 화염병을 누가 던졌는지 규명하지 못했다. 검찰 수사는 ‘법질서를 위해 불가피한 조처’라고 한 경찰의 야만에 기만으로 화답한 것이다.

  그 뒤로도 희생자와 유족들을 두 번 세 번 죽이는 일이 계속됐다. 청와대와 정부 여당은 날조된 수사결과를 바탕으로 진실을 은폐하고 사건을 덮는 데 급급해 왔다. 엊그제는 추모행사가 원천봉쇄된 가운데 몸싸움으로 영정이 내동댕이쳐져 훼손되는 일도 있었다. 국민을 섬기겠다는 정부라면 도저히 할 수 없는 짓이다. 용산 참사는 이 정권의 가장 큰 오점으로서, 어떤 공권력과 여론조작으로도 흐리거나 지울 수 없다.

  우리는 고 김수환 추기경을 가난하고 소외된 자의 벗이었기에 한마음으로 애도했다. 김 추기경이 가장 가슴 아파 할 일에 대해서 외면하는 것은 고인의 뜻에 어긋난다. 용산의 해원은 우리 사회의 몫이다. 이명박 대통령은 유가족 앞에 사죄하고 사건에 대해 전면 재조사가 이뤄지도록 해야 한다.
