A Cabinet meeting the day before yesterday approved the passage of a plan to reorganize the National Human Rights Commission of Korea (NHRCK), according to its original draft by the Ministry of Public Administration and Security (MOPAS), cutting NHRK’s workforce by more than 20%. In response, the NHRCK applied to the Constitutional Court for an injunction to suspend the validity of the executive order on the organization’s rearrangement plan, and requested a trial reviewing the status as an independent commission. This proves to be a curious case study regarding which state organization has the power to determine the outcome of this bill.

  Responsibility for the situation coming to this point falls entirely on the government, which pushed forward this reorganization plan while disregarding public opinion. The NHRCK was established as an independent organization under Article 10 of the Constitution, not as an office within the executive branch. Yet MOPAS unilaterally presented the reorganization plan without once engaging in proper discussions with the NHRCK. Nor did it present proper justification for its downsizing. The NHRCK requested discussion and resolution of the matter through various channels, including an all-members meeting, predicated on the commission’s independent status, but its requests were completely ignored. MOPAS has also ignored public criticism coming from within South Korea and overseas. This sort of thing cannot be allowed to happen, unless it means that the government remains unconcerned with either the NHRCK’s independent character and critical public opinion.

  A far greater problem than disregard for NHRCK’s independent status in the process of managing reorganization, is the fact that the commission itself will in all likelihood be rendered powerless if this downsizing plan is carried out. According to the recently passed rearrangement plan, the areas that will suffer the biggest blow are the branches dealing with investigation, policy and education. We can easily determine what this will mean if we look at the recent report of NHRCK’s activities.

  The commission received over 6,700 petitions last year, approximately 2.3 times as many as compared to the number received when it first opened in 2001. There were also around 30,000 counseling and complaint cases, around 10 times as many as those registered in 2001. Furthermore, it is clear that the amount of investigative work will only further increase with the implementation of the Disability Discrimination Act and the Age Discrimination Act. To cut the investigative staff at this time is tantamount to telling the commission to not work at all.

  Another major problem in the plan to consider is the fact the first staff cuts will inevitably fall on special government positions and to general contract workers. This means that staff with professional expertise and sensitivity to human rights will be cut, and the NHRCK will become transformed from an independent body into an organization of public officials. Once this happens, it would be all too easy for the commission to lose its independent character completely and devolve away from its original mandate.

  It is clear where the government’s real intentions lie as it pushes forward its reorganization plan, without regard to the various criticisms offered by the public. The government wants to incapacitate the NHRCK, an organization that stands for independence and does not shy away from criticizing the government. Now the question of whether the commission will be able to properly perform its duty of protecting human rights depends on the determination of the Constitutional Court. Here’s to hoping it makes the wise decision.

국가인권위원회를 눈엣가시로 여기는 정권

  국무회의는 국가인권위원회(인권위) 인원을 20% 이상 줄이는 직제개정령안을 그제 행정안전부 원안대로 통과시켰다. 인권위는 이에 맞서 직제개정안에 대한 대통령령 효력정지 가처분신청과 권한쟁의 심판청구를 헌법재판소에 냈다. 국가기관 사이 권한을 다투는 희귀한 사태가 발생한 것이다.

  사태가 이 지경에 이른 책임은 전적으로 여론에 귀 막은 채 직제개정안을 밀어붙인 정부에 있다. 인권위는 행정부의 일개 부처가 아닌 독립적 헌법기관이다. 그런데도 행안부는 인권위와 제대로 된 협의 한 번 하지 않은 채 일방적으로 직제개편안을 마련했다. 조직을 축소해야 하는 이유도 제대로 내놓지 않았다. 인권위는 전원회의 등 다양한 통로를 통해 독립성을 전제로 협의 처리할 것을 요구했지만 철저히 외면당했다. 비등하는 국내외의 비판 여론도 완전히 무시됐다. 인권위의 독립성이나 비판 여론 따위는 안중에 없다는 뜻이 아니고서는 있을 수 없는 일이다.

  처리 과정에서 인권위의 독립성이 무시된 것보다 훨씬 더 큰 문제는 축소안이 관철되면 인권위 자체가 무력해질 가능성이 높다는 점이다. 통과된 직제개편안에 따라 가장 큰 타격을 입는 부문은 조사·정책·교육 분야다. 인권위의 최근 업무 현황을 보면 이것이 무엇을 의미하는지 쉽게 알 수 있다. 지난해 인권위에 접수된 진정 건수는 6700여건으로, 처음 문을 연 2001년의 2.3배나 된다. 상담·민원은 10배 정도 는 3만건에 이른다. 여기에 장애인차별금지법과 연령차별금지법이 시행됨에 따라 조사 업무량이 더 늘어날 것은 불을 보듯 뻔하다. 이런 상황에서 조사인력을 줄이는 것은 일을 하지 말라는 것이나 다름없다.

  직제개편에 따른 인원 감축 우선순위가 별정직이나 일반계약직이 될 수밖에 없다는 점 역시 큰 문제다. 전문성과 인권 감수성이 있는 전문인력이 배제돼 인권위가 공무원 중심 조직이 된다는 얘기다. 이렇게 되면 인권위는 독립성을 잃고 구색 맞추기 조직으로 전락하기 쉽다.

  이렇게 보면 온갖 비판 여론에도 아랑곳하지 않고 직제개편안을 밀어붙인 정부의 본뜻이 어디 있는지 분명해진다. 독립성을 내세우며 정부에 대한 비판도 마다 않는 인권위를 무력화하겠다는 것이다. 이제 인권위가 국민의 인권 보호 업무를 제대로 할 수 있을지는 헌법재판소의 판단에 달렸다. 헌재의 명철한 판단을 기대한다.
