In the wake of the police search and seizure of the Democratic Labor Party (DLP) server, opposition parties have now arrived at the decision to jointly submit a motion for the dismissal of Prime Minister Chung Un-chan. Chairs of the four opposition parties held an emergency meeting yesterday morning, where they deemed the DLP search and seizure a clear case of suppression against opposition forces and decided to strongly hold the government accountable during February’s extraordinary session of the National Assembly. Additionally, the DLP’s Supreme Council and all of its lawmakers have begun an indefinite protest. The DLP search and seizure issue has become a new source of conflict and confrontation in the political world.
One cannot help but say that the police are entirely to be blamed for the situation racing quickly downhill as it has. As some have already pointed out, the police search and seizure of the DLP serve was a clear example of an excessive investigation. Moreover, despite conducting searches on two occasions, the police have been unable to confirm whether the Korean Teachers and Education Workers’ Union (KTU, Jeon Gyo Jo) and the Korean Government Employees’ Union (KGEU) members in question are even members of the DLP. The police are directing their criticism at the DLP, saying that the server’s hard disk had disappeared with important information on it, but they gain nothing more in making this type of statement than advertising their own incompetence for all the world to see. If after all this fuss they still failed to find what they were after, they have nothing to say in their own defense. At this point, it is the epitome of childishness for them to voice complaints and excuses about how the DLP made the server connection channel too complicated, or how the courts did not give them comprehensive search and seizure warrants for online investigations as they do in Germany.
Judging from the recent behavior of the police, they appear to be running around with unnecessarily large swords. It is a worrisome sight. They seem to be stabbing indiscriminately in one place, and if they do not find what they are after, they begin to swing in another direction. According to their logic, they have no choice now but to search the entire DLP headquarters to find the hard disk that has vanished. What is next if they still fail to find it? In addition, the police say that the hard disk in question contains “important information,” but this is nothing more than a conjecture and is difficult to place a great deal of trust in it.
It has been stated before, but this investigation has been off from the very beginning. We are now seeing a vicious cycle in which one quick, foolish move begets another. A political party’s server is the equivalent of a party’s file cabinet and safe in its inner headquarters. If the police state their intention to and search through everything contained in the party’s innermost quarters, what party would calmly accept that and acquiesce? Beyond that, the police have already lost any legitimacy in their investigation by becoming caught up in illegal login allegations. It is our hope that they will soon come to their senses.

정치적 분란’만 키우는 경찰

경찰의 민주노동당 서버 압수수색이 급기야 야당의 정운찬 총리 해임건의안 공동제출 결정으로까지 이어졌다. 야 4당 대표는 어제 오전 긴급회동을 갖고 민노당 압수수색을 명백한 야권탄압으로 규정하고, 2월 임시국회에서 정부의 책임을 강력히 묻기로 했다. 민노당은 최고위원 및 의원단 전원이 무기한 농성에 들어갔다. 경찰이 정당의 조직과 살림살이 일체를 뒤지겠다는 것이니, 야당으로선 가만히 있을 순 없을 것이다.
상황이 이렇게 악화일로를 치닫게 된 것은 전적으로 경찰의 잘못 때문이다. 이미 지적했듯이 경찰의 민노당 서버 압수수색은 명백한 과잉수사다. 게다가 경찰은 두 차례나 압수수색을 하고서도 전교조와 전공노 조합원들의 민노당 가입 여부조차 확인하지 못했다. 경찰은 “중요자료가 들어 있는 서버의 하드디스크가 사라져버렸다”며 민노당에 화살을 돌렸지만, 이는 자신의 무능함을 만천하에 광고하는 것일 뿐이다. 이렇게 야단법석을 떨고서도 예고했던 목적물을 찾아내지 못했으니 입이 열 개라도 할 말이 없다. 이제 와서 민노당이 서버 접속 경로를 복잡하게 해놓았네, 독일처럼 온라인 수사에 대한 포괄적인 압수수색 영장을 법원이 주지 않았네 하는 식의 푸념이나 변명을 늘어놓는 것은 유치하기 짝이 없다.
경찰이 요즘 하는 모양새를 보면 철부지가 칼을 들고 설치는 것 같아 조마조마하기 짝이 없다. 칼로 여기를 찔러보았다가 아니다 싶으면 또 저기를 쑤셔보는 식이다. 경찰 논리대로라면 이제 없어진 하드디스크를 찾아내기 위해 민노당 당사 전체를 압수수색할 수밖에 없게 됐다. 그렇게 하고도 하드디스크를 찾아내지 못하면 그다음은 또 어떻게 할 것인가. 경찰은 없어진 하드디스크에 ‘중요자료’가 들어 있다고 말하고 있으나, 그것부터가 별로 믿음이 가지 않는 ‘추정’일 뿐이다.
다시 한번 강조하지만 이번 수사는 애초부터 첫 단추를 잘못 꿰었다. 그러다 보니 무리수가 무리수를 낳는 악순환이 계속되는 것이다. 한 정당의 서버는 그 당의 안방에 있는 장롱이며 금고에 해당한다. 경찰이 아예 안방까지 들어와 내용물을 샅샅이 들여다보겠다는데 가만히 당하고만 있을 정당이 어디 있겠는가. 게다가 경찰은 이미 ‘불법 로그인’ 의혹에까지 휘말림으로써 스스로 수사의 정당성까지 잃어버렸다. 경찰이 제발 정신을 차렸으면 한다.
